Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CasaDireta platform. By creating an account or using the platform, you agree to these Terms. If you do not agree, please do not use the platform.
1. About CasaDireta
CasaDireta is an online platform (an information-society and classifieds service) that enables direct property transactions between buyers and sellers in Portugal, without real estate agents. CasaDireta is a technology service provider and not a real estate agency; we do not hold an AMI licence and we do not act as a broker or mediator in transactions.
2. Eligibility and Accounts
You must be at least 18 years old and able to enter into a binding contract to use CasaDireta. You must provide accurate, current and complete information when registering and keep it up to date. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
3. Property Listings
Sellers are solely responsible for the accuracy, legality and completeness of their listings, including descriptions, prices, photographs and location. To help protect buyers, CasaDireta may require and verify ownership and identity documents (such as the Certidão Permanente and Caderneta Predial) before a listing is published. We reserve the right to refuse, edit or remove any listing that violates these Terms or applicable law.
4. Fees and Payment
Publishing a property requires a one-time flat listing fee of €190. Applicable VAT (IVA) is included or added as required by law. The fee covers publication and verification of the listing and is non-refundable once the listing has been published, except where required by mandatory consumer law. We do not charge a commission on the sale price.
5. Role of the Platform
CasaDireta provides a venue for users to connect and is not a party to any agreement, negotiation or transaction between buyers and sellers. We do not provide legal, financial, tax or notarial advice. Users are responsible for conducting their own due diligence and for complying with all applicable Portuguese laws relating to property transactions, including notarial and tax requirements.
6. User Content
You retain ownership of the content you submit (such as listing text and photographs). By submitting content, you grant CasaDireta a non-exclusive, worldwide, royalty-free licence to host, display and distribute it for the purpose of operating and promoting the platform. You represent that you hold the necessary rights to the content you submit and that it does not infringe the rights of others.
7. Identity and Ownership Verification
To reduce fraud, CasaDireta may carry out identity and property-ownership verification, including reviewing official documents. You agree to provide truthful documents and information. Submitting false, forged or misleading documents is a serious breach of these Terms and may be reported to the competent authorities.
8. Prohibited Activities
You may not: post fraudulent, misleading or unlawful listings; impersonate others; use the platform for money laundering or any illegal purpose; harass, threaten or defraud other users; scrape, overload or interfere with the platform; or attempt to circumvent our verification or security measures. Violations may result in immediate suspension or termination.
9. AI Assistant
Our AI assistant provides general, informational responses only. It is not a lawyer, notary, financial advisor or tax advisor, and its responses do not constitute legal, financial or professional advice. You should always confirm important matters with a qualified professional (such as a lawyer or notary) before acting.
10. Limitation of Liability
To the maximum extent permitted by law, CasaDireta is not liable for indirect, incidental or consequential losses, or for losses arising from transactions conducted between users. We do not guarantee the accuracy of listings or the conduct of users. Nothing in these Terms limits liability that cannot be excluded under mandatory law, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnification
You agree to indemnify and hold CasaDireta harmless from claims, damages and expenses arising out of your use of the platform, your content, or your breach of these Terms or of applicable law.
12. Suspension and Termination
You may close your account at any time. We may suspend or terminate access where you breach these Terms, where required by law, or to protect the platform and its users. Provisions that by their nature should survive termination (such as liability, indemnity and governing law) will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notifying you. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by Portuguese law. Subject to any mandatory consumer-protection rights, disputes shall be subject to the jurisdiction of the courts of Lisbon, Portugal. EU consumers may also use the European Commission Online Dispute Resolution platform.
